WARRANTY

Limited Warranty: PGS warrants to you that the products sold to you at the time of installation are free from defects in materials and workmanship. Warranty on products and / or replacement parts of products are as provided by the relevant manufacturer. Warranty on labor is one (1) Year from date of installation. As your sole and exclusive remedy under this warranty, PGS agrees to, at its option, to either (a) to repair or replace any part or parts of such defective equipment or products, or (b) exchange and replace the complete product.

This warranty does not cover loss, damage or defects resulting from improper use as it is advertised by the relevant manufacturer of the product, inadequate maintenance by you, your supplied materials, unauthorized modifications or misuse by you, operation outside of the environmental specifications for materials or improper site preparation or maintenance. No warranty is made with respect to used, reconstructed, refurbished or previously owned materials, supplies or equipment, which will be so marked on the face hereof and, unless otherwise indicated on the face hereof, shall be sold “As Is”.

EXCEPT AS EXPRESSLY STATED ABOVE, PGS MAKES NO OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO THE PRODUCTS, EQUIPMENT OR SUPPLIES, INCLUDING WITHOUT LIMITATIONS ANY IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ALLOWED UNDER STATE LAW. THE REMEDIES PROVIDED HEREIN ARE YOUR SOLE AND EXCLUSIVE REMEDIES. PGS SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, ARISING OUT OF THE DESIGN, MANUFACTURE, SALE, DELIVERY, INSTALLATION, SERVICE OR USE OF THE PRODUCTS.
